SOS LABELS — TERMS OF SERVICE

Effective Date: October 14, 2026

These Terms of Service (“Terms”) govern the website, claims process, and related technology provided by SOS LABELS LLC (“SOS,” “SOS Labels,” “we,” “us,” or “our”).

Where acceptance is required, these Terms will be presented through the applicable checkout, account, or service process.

01. Our Services

SOS provides optional package protection through participating e-commerce merchants.

Customers may purchase protection for eligible orders at checkout. SOS reviews claims involving eligible delivery loss, theft, or damage. For approved replacement claims, SOS purchases the replacement from the participating merchant, which fulfills the purchase through its ordinary operations.

SOS does not transport or deliver packages. Merchants and their shipping providers perform fulfillment and delivery.

02. Related Agreements

Our Privacy Policy explains our personal information practices.

Our Protection Terms & Conditions govern protection purchases, eligibility, exclusions, filing deadlines, and claim resolutions.

A separate Merchant Agreement governs a participating merchant’s commercial relationship with SOS.

The Protection Terms & Conditions control any conflict concerning a protection purchase or claim. The Merchant Agreement controls matters expressly addressed in that agreement concerning the merchant relationship.

03. Eligibility and Authority

You must have the legal capacity to enter the applicable agreement.

If you act for a business or another person, you must have authority to do so. Information you provide must be accurate, and your use of the Services must be lawful.

04. Accounts and Access

You are responsible for protecting any credentials issued to you and promptly reporting suspected unauthorized access.

You must not access another person’s information without authorization or share credentials in a manner that compromises security.

SOS may verify identity, authority, and relevant order information before providing access or acting on a request.

05. Protection Purchases and Pricing

Protection is optional. Customers see the applicable price before completing their purchase.

Pricing varies by merchant and order. Merchant pricing is agreed privately during onboarding and may be custom.

Cancellation, refunds, and protection benefits are governed by the Protection Terms & Conditions accepted for the purchase.

Merchant commercial arrangements are governed by the applicable Merchant Agreement. These Terms do not impose a separate merchant fee.

06. Acceptable Use

You must not:

SOS may investigate suspected misuse and take proportionate steps to protect the Services.

07. Submitted Materials

You retain your rights in photographs, documents, and other materials you submit.

You authorize SOS to use and disclose those materials as reasonably necessary to provide the Services, review claims, coordinate resolutions, prevent fraud, comply with law, and resolve disputes, consistent with our Privacy Policy.

Submitting claim materials does not authorize their use in public advertising.

08. Intellectual Property

SOS branding, software, graphics, website content, and proprietary materials belong to SOS or its licensors.

You may use the Services for their intended purpose. You may not reproduce, distribute, sell, or commercially exploit proprietary materials without permission, except as permitted by law or a separate agreement.

09. Merchants and Other Providers

Merchants remain responsible for product descriptions, product quality, ordinary fulfillment, and their independent return and exchange policies.

Platforms, payment processors, and carriers may have separate terms.

Issues involving sizing, buyer’s remorse, or defects unrelated to delivery are generally addressed with the merchant. Nothing in these Terms limits mandatory rights concerning your purchase.

10. Availability and Changes

We may update the Services or perform maintenance. We do not guarantee uninterrupted or error-free access.

If a technical issue prevents claim submission, email [email protected] promptly with your order details and a description of the issue.

Changes to the Services do not retroactively reduce benefits owed under an existing protection purchase.

11. Suspension and Termination

SOS may restrict access for material violations, unlawful activity, security concerns, or fraudulent use.

Where appropriate, we will provide notice and an opportunity to address the issue.

Suspension does not automatically cancel a valid protection purchase or eliminate obligations already owed. Suspected fraudulent claims may be investigated under the Protection Terms & Conditions.

12. Disclaimers and Responsibility

Except for express contractual commitments and rights required by law, the general website and technology are provided on an “as available” basis.

Nothing in these Terms removes SOS’s obligation to provide an approved protection benefit or excludes liability that cannot lawfully be excluded.

To the extent permitted by law, neither party is responsible for indirect or consequential losses arising from use of the general website or technology. This does not exclude direct protection benefits, liability for fraud or willful misconduct, or other nonexcludable liability.

13. Disputes and Governing Law

Contact [email protected] with a description of the issue and the resolution requested. We will attempt to resolve the matter in good faith.

These Terms are governed by New Jersey law, subject to mandatory protections applicable where you live.

Subject to applicable jurisdictional rules and mandatory rights, disputes may be brought in courts with jurisdiction in New Jersey. This provision does not prevent a consumer from bringing proceedings elsewhere where applicable law provides that right.

Nothing restricts your right to contact a regulator or exercise a nonwaivable legal right.

14. Updates to These Terms

Updates apply prospectively. We will provide notice and obtain renewed acceptance where required.

The Protection Terms & Conditions accepted when protection was purchased continue to govern that purchase unless a lawful, agreed change applies.

15. General Provisions

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.

Failure to enforce a provision does not waive later enforcement.

SOS may transfer its agreements in connection with a lawful business transfer without reducing existing customer rights.
